What is a Personal Injury Case?

Personal injury claims arise when a person is injured due to the carelessness or intentional acts of another person. If a person does something that is careless, or does something that is intended to hurt another person, and the victim is injured as a result of that careless or intentional action, then the injured party may be able to obtain compensation for the harms caused by that action.

An injured person is entitled to recover compensatory damages from the wrongdoer, an amount of money which is intended to put the injured party back in the same position as he or she was before the injury. Compensatory damages include some items that are easy to identify. These include medical expenses, lost income, the cost of household and/or personal help for things the injured person can no longer do. Compensatory damages also include the pain, suffering and mental anguish that the victim endures. The injured person’s spouse may also have a claim.

If the injury is caused by an intentional action by the wrongdoer or an action that is considered egregious, then the victim may also be entitled to recover punitive damages, which are intended to punish the wrongdoer rather than merely compensate the victim. The most common type of egregious conduct is when a person who is driving under the influence of alcohol or drugs causes a car wreck.

Common Types of Personal Injury Cases

Personal injury claims most frequently arise out of car accidents. Other common personal injury claims are from slip and falls, motorcycle accidents, and defective products, but they can happen from many other unusual situations, such as dog bites, shopping cart mishaps and golf care rollovers, just to name a few. Whatever the cause of the injury, the most important thing is to get the appropriate medical care as soon as possible.
