Other attorneys require that their clients pay an independent physician to review the files. If you have a medical dispute that could result in a medical malpractice proceeding, we want you to understand how the process works. First, you'll have a consultation with one of our attorneys. You'll tell your story and turn over all the medical documentation you've collected during the treatment you are questioning. We'll perform a complete review of all the medical records you have. We are able to do this in-house because we have a physician on staff. Not every bad result from a medical procedure is the result of negligence - you can count on Kaplan & Lukowski not to undertake a case that we don't believe we can win. Our goal is to resolve every case WITHOUT going to trial. Mediation is often effective at settling medical malpractice claims. The typical length of time for settlement is 12 to 18 months. If the case goes to trial, it can take as long as two - three years to complete. If we take the case, we will advance all expenses for the preparation of the case: all expert opinion, expert reports, travel and deposition expenses. There will be no cost to you.
